OBJECT OF THE CONTRACT

This contract aims to regulate the contractual relationship between Improve Artes S. Coop. And. (hereinafter referred to as IMPROVE Educación Musical) and the User at the moment the User purchases any product. Both the purchasing process and access to and hosting of our digital products are facilitated through Gumroad Inc.

This contractual relationship will grant the User access to digital content and web applications distributed by IMPROVE Educación Musical through the websites https://www.emimprove.com/en/shop/ and https://emimproveen.gumroad.com/ in exchange for a specified price publicly displayed on these websites.

The products offered by IMPROVE Educación Musical can only be purchased by legal entities and individuals who are of legal age.

COMMENCEMENT, DURATION, AND TERMINATION

These terms and conditions will remain valid indefinitely and will take effect when the User purchases any of the digital products offered by IMPROVE Educación Musical on its websites.

IMPROVE Educación Musical may modify these conditions by publishing each new version of the general purchase terms at https://www.emimprove.com/en/shop/ (at the bottom of the page).

IMPROVE Educación Musical will not send copies of new versions, and it is understood that the versions published at https://www.emimprove.com/en/shop/ at any given time will always be considered current.

Additionally, IMPROVE Educación Musical will inform customers of any new version of the general terms by posting a visible notice on the website https://www.emimprove.com/en/shop/.

IMPROVE Educación Musical may suspend the fulfillment of the contractual terms (i.e., halt services) in cases of suspected fraudulent use of the services purchased or non-payment.

 

PURCHASE PROCESS

Users must follow the purchase process at https://www.emimprove.com/en/shop/, where they can select a product. When initiating the purchase, a pop-up with a Gumroad Inc. form will appear, requiring the completion of necessary fields (personal information, email, payment method, coupons, and subscriptions).

After purchasing, you will receive an email with instructions to access the content and a receipt for the payment. If you need an invoice, it must be requested directly from Gumroad. Access to the acquired content can be made through the Gumroad application, available for web and mobile.

IMPROVE Educación Musical does not store any transaction data as the process is handled externally by Gumroad Inc. If you wish to view Gumroad’s general terms of purchase, please visit: https://gumroad.com/privacy.

However, IMPROVE Educación Musical may have access to the User’s email and name (the latter only if provided by the User) through the service provided by Gumroad Inc.

Users can opt during the purchase process to receive future communications from IMPROVE Educación Musical.

PRICES AND PAYMENT METHODS

The prices displayed on the website do not include VAT or other taxes. Taxes will be added during the purchase process and calculated automatically for each country according to its current legislation by Gumroad Inc.

Users should note that the final purchase price will be displayed in U.S. dollars, and there may be currency exchange fluctuations.

Prices may vary over time but will not affect purchases already made.

Offers: The website may include offers or promotions on certain products or sets of products, and IMPROVE Educación Musical reserves the right to modify the terms and conditions of offers without prior notice. However, the current offers at the time of purchase will apply.

USAGE LICENSES

IMPROVE Educación Musical holds all intellectual and industrial property rights over the content available for sale on the websites https://www.emimprove.com/en/shop/ and https://emimproveen.gumroad.com/.

IMPROVE Educación Musical grants the User the right to use the marketed content for strictly personal use. This license is non-exclusive, worldwide, and subject to legal limits. The User agrees not to use the purchased products for any purpose other than personal, non-commercial use.

The reproduction, distribution, and public communication of the content sold on this website, whether for commercial purposes or even for free, in any format or by any technical means, without the authorization of IMPROVE Educación Musical, are expressly prohibited.

The following actions are expressly prohibited for Users regarding the purchased products:

  • Reproduction: Users cannot copy or modify the purchased content.
  • Public Communication: Users cannot publicly display or distribute the content in any form, whether for free or not, unless expressly permitted by law.
  • Distribution: Users cannot sell, lease, or otherwise commercialize the content.
  • Transfer to Third Parties: Users cannot transfer their rights to third parties.
  • Security Measures: Users cannot disable any technological security measures implemented by IMPROVE Educación Musical.
  • Property Notices: Users cannot remove any legal or ownership notices from the content.
  • Written Notification: Users must immediately notify IMPROVE Educación Musical of any suspected violations of these terms.
  • Access Withdrawal: IMPROVE Educación Musical reserves the right to withdraw access to the products immediately in the event of intellectual property rights violations by the User.
  • Compatibility: IMPROVE Educación Musical is not responsible for compatibility issues between the User’s browser and the products.
  • Shared Purchases: Shared purchases to reduce costs are not allowed. Each license is personal and non-transferable.

Any unauthorized use will be considered a serious violation of intellectual and industrial property rights, and IMPROVE Educación Musical reserves the right to pursue civil and criminal actions to protect its rights.

RIGHT OF WITHDRAWAL

Since these are digital products, the customer is not entitled to a withdrawal (refund) of the purchase.

APPLICABLE LAW, JURISDICTION, CLAIMS, AND ARBITRATION

  • Applicable Law: All relationships between IMPROVE Educación Musical and the User are governed by Spanish law.
  • Jurisdiction: In case of legal disputes, they will be resolved in Spanish courts.
  • Claims: Claims should be addressed to IMPROVE Educación Musical via email at ventas@emimprove.com.

For unresolved disputes, consumers residing in the European Union may seek Alternative Dispute Resolution (ADR).

SERVICE TERMINATION

IMPROVE Educación Musical may terminate the User’s access rights if these Terms are violated.

CONTENT REMOVAL

IMPROVE Educación Musical reserves the right to remove any product or part of a product at any time.

LIMITATION OF LIABILITY

IMPROVE Educación Musical‘s total liability shall not exceed the amount paid by the User for the product.
